Fani Willis is fighting back after the Georgia Court of Appeals removed her from the Trump RICO case.
As previously reported, Fulton County DA Fani Willis and her entire office were disqualified from prosecuting Trump in their RICO lawfare case.
While the appeals court did not dismiss the charges, it ruled that Fani Willis and her office have “no authority to proceed.”
The Georgia Appeals Court disqualified Fani Willis due to an appearance of impropriety.
Fani Willis has asked the Georgia Supreme Court to reinstate her on the case before Trump’s inauguration, warning that she may take further action if not.
The Georgia Supreme Court did not need to hear Fani Willis’ appeal.
Even if the Georgia Supreme Court rules in favor of Fani Willis, Trump will be in office by noon next Monday.
However, at least 14 other co-defendants in this case may still have to fight Fani Willis.
As reported by Fox 5 Atlanta:
Fulton County District Attorney Fani Willis has asked Georgia’s highest court to review a lower appeals court’s ruling that removed her from the Georgia election interference case against President-elect Donald Trump and others.
In December, the Georgia Court of Appeals ruled that Willis and her office could not continue to prosecute the case because of an “appearance of impropriety” created by a romantic relationship she had with special prosecutor Nathan Wade, whom she had hired to lead the case. In a petition filed late Wednesday, Willis asked the Georgia Supreme Court to review and reverse that decision.
Willis’ filing argues that the 2-1 ruling “overreached the Court of Appeals’ authority,” creating a new standard for disqualification of a prosecutor and disregarding decades of precedent.
