JUST IN: Federal Judge Rejects Hunter Biden’s Latest Attempt to Have Tax Evasion Charges Dismissed

A federal judge on Monday denied Hunter Biden’s recent effort to have tax evasion charges dismissed in a case set to go to trial next month in Los Angeles.

The decision came as Hunter Biden traveled to Chicago for the Democratic National Convention, where he witnessed his father bid farewell after being unexpectedly replaced by Vice President Kamala Harris as the Democratic nominee in the 2024 presidential race.

UPI reports that President Joe Biden’s son is facing nine charges in California for allegedly failing to pay $1.4 million in taxes from 2016 to 2019.

In July, his legal team attempted to dismiss the case by referencing a recent federal court decision in Florida, where the judge dismissed the classified documents case against Donald Trump, arguing that the appointment of Special Counsel Jack Smith was unconstitutional. According to the UPI report:

In the seven-page ruling Monday, District Judge Mark Scarsi of the U.S. District Court of Central California did not touch on the merits of Bidenโ€™s argument but rejected it for being untimely and an attempt to relitigate a decision that quashed a previous attempt by Biden to have the case dismissed.

โ€œMr. Biden plainly seeks reconsideration of issues already decided upon his February motion,โ€ Scarsi said.

โ€œThe Court declines to reach the merits of the motion because there is no valid basis for reconsideration of the Courtโ€™s order denying Mr. Bidenโ€™s motion to dismiss the indictment for Appropriations and Appointments Clause violations.โ€

Hunter Biden is facing nine felony and misdemeanor charges related to his failure to pay $1.4 million in taxes over three years, a period during which he struggled with addiction.

The back taxes and penalties were fully covered by a third party, who ABC News identifies as Kevin Morris, Hunter Biden’s attorney and confidant.

The trial is scheduled to begin on Sept. 5. Hunter Biden has pleaded not guilty to all charges.

He was previously found guilty on three gun-related charges in June and awaiting sentencing.
