Biden-Appointed Judge Jia Cobb Assigned to Rule on DC Lawsuit Over Trump’s National Guard Deployment

Washington, DC Attorney General Brian Schwalb’s lawsuit challenging Trump’s deployment of the National Guard has been assigned to Biden-appointed Judge Jia Cobb. Politico legal correspondent Josh Gerstein broke the news.

Earlier Thursday, Schwalb sued Trump, the Department of Defense, the Department of Justice, the U.S. Marshals Service, and the U.S. Army over the deployment of National Guard troops for crime deterrence and law enforcement.


This follows a ruling earlier Tuesday by San Francisco federal judge who blocked President Trump from deploying the National Guard to Los Angeles, claiming he was creating a “national police force” and acting as its “chief.”

The same judge had ordered Trump to return control of the National Guard to California in June, but that decision was overturned on appeal.

The lawsuit from Schwalb argues that the deployment of National Guard troops “violates both the Home Rule Act and a congressionally approved compact governing the interstate mobilization of state National Guard troops.”

It also argues that the President lacks the authority to command out-of-state National Guard troops from the seven contributing states.


The move comes as President Trump hints at plans to expand the National Guard deployment to combat crime in other cities, starting with Chicago.

The Biden-appointed judge is expected to side with Schwalb, potentially blocking the President’s plans to address the public safety crisis in Democrat-run cities, where violent crime is surging.

Cobb is also overseeing a lawsuit from Federal Reserve Governor Lisa Cook over Trump’s firing of the embattled Fed Governor with cause amid evidence of mortgage, occupancy, and tax fraud. The Justice Department formally opened a criminal investigation on Thursday against Cook and issued subpoenas.

Previously, Judge Cobb blocked the Trump Administration from carrying out expedited deportations of illegal aliens under the “Protecting the American People Against Invasion” Executive Order.
